The Government of West Bengal on May 29, 2025, notified regarding the Permission for 24x7 Operation of Shops & Establishments in West Bengal.
The notification grants permission to shops and establishments registered under the West Bengal Shops & Establishments Act, 1963, employing 20 or more persons, to operate 24x7 throughout the year. This permission is valid for a period of three years from the date of publication, subject to compliance with specified provisions of the Act and conditions laid down by the government.
Employers are required to ensure proper workforce management, including appointing additional staff so that employees can avail weekly holidays. They must issue appointment letters to all employees and display employee details, including those on leave, at a visible place in the establishment.
The notification also emphasizes employee welfare and safety. It mandates limits on overtime (not exceeding 144 hours per quarter), provision of basic facilities such as restrooms, medical support, and safety lockers, and transport arrangements for women working in shifts. Additionally, employers must establish an Internal Complaints Committee under the Sexual Harassment of Women at Workplace Act, 2013.
Non-compliance with any of the stated conditions or provisions of applicable labour laws may result in penalties, including suspension or cancellation of the granted permission. The order comes into immediate effect.
